Practice profile

Joyce practices both both civil and criminal litigation. She commenced practice in 2016 upon completion of her pupillage with Mr. Wong Man Kit S.C., Ms. Amanda W.M. Li and Mr. Christopher Chain. She has appeared in the Court of Appeal, the Court of First Instance, the District Court (including the Family Court), the Lands Tribunal and Magistrates’ Courts either in her own right or a led junior.

Joyce has been developing a broad civil practice and accepts instructions in all areas of chambers’ work. She has been instructed for both advocacy and advisory work on matters covering a wide range of areas of law including contract, property and trusts, building management, general tort, personal injury and employee compensation, company, bankruptcy and winding-up, judicial review, family and probate as well as other civil and commercial disputes.

Joyce is also developing a growing criminal practice and accepts instructions in all areas of criminal matters. She has undertaken an array of defence work including legal visits, bail applications, pleas in mitigation, trials and magistracy appeals. She also regularly prosecutes for the DOJ in the Magistrates’ Courts. She has experience in handling cases involving traffic offences, sexual offences, theft, conspiracy to defraud, breach of conditions of stay, dangerous drugs-related offences, criminal intimidation, assault as well as white-collar cases such as Securities and Futures Commission matters.

Joyce can conduct cases and draft pleadings in both English and Chinese. Joyce has also completed the HKMAAL approved mediation training.

Civil Cases

Ng Yeuk Chu Winnie v. Ng Sung Kui & Anor [2021] HKCFI 2116; HKCFI 2524 – Court of First Instance – Probate – Acted for the 2nd Defendant (as sole advocate) (who supported the appointment of the 1st Defendant) in a dispute over the appointment of the administrator of an estate involving issues of intermeddling and retraction of renunciation of administration. The Court appointed the 1st Defendant as the sole administrator of the Estate, and dismissed the Plaintiff’s application with costs to both Defendants. The Plaintiff’s subsequent application to vary the costs order nisi was also dismissed.

Chiou Hsin Ying v. Wong Shing Yu Byron [2021] HKDC 1225 – District Court – Trial – Acted for the Plaintiff (as sole advocate) – Water seepage.

Wu Tak Hung v. Lee Hoi [2021] HKDC 1148 – District Court – Trial – Acted for the Defendant (as sole advocate) – Contractual dispute.

Sit Sau Ming v. Leung May Chun Alison Aliance & Anor [2020] HKDC 137 – District Court – Re-trial – Acted for the Plaintiff (led by Mr. Benjamin Chain) – Breach of sale and purchase agreement involving issues of rescission and duty of solicitors who act for both the vendor and the purchaser to raise requisitions – successfully obtained an order of specific performance.

Man Cheuk Hei Alice v. The Hong Kong Housing Authority & Anor. (HCAL 2142/2019) – Court of First Instance –Judicial Review – Acted for the Applicant (as sole advocate).

CYK v. LTH [2020] HKFC 277 – Family Court – Trial on ancillary relief – Acted for the Petitioner (as sole advocate). Successfully persuaded the Court that the Respondent had dissipated assets and adverse inference drawn against the Respondent for non-disclosure.

The Incorporated Owners of Fortune Gardens v. Chan Grant & Anor [2018] HKLdT 53 – Lands Tribunal – Trial – Acted for the Applicant (as sole advocate). Breach of deed of mutual covenant involving issues of acquiescence and proprietary estoppel – successfully obtained an injunction for the reinstatement of waterproof membrane.

THY v. CHFR [2018] HKCA 240 – Court of Appeal – Application for leave to appeal to the Court of Appeal against stay of cross-petition – Acted for the Respondent (as sole advocate).

Hong Kong Property Mortgage Limited v. Ng Lai Ping Cathy [2018] HKDC 432 – District Court – Trial – Acted for the Defendant (as sole advocate) – successfully resisted a moneylender’s claim involving issues of illegal fee-charging, early repayment clauses, compound interest and calculation of interest rate.

THY v. CHFR [2018] HKFC 10 – Family Court – Application for leave to appeal to the Court of Appeal against stay of cross-petition – Acted for the Respondent (as sole advocate).

Sit Sau Ming v. Leung May Chun Alison Aliance & Anor (Unrep.,DCCJ 4453/2008, 12th December 2017) – District Court – Trial – Acted for the Plaintiff (led by Mr. Benjamin Chain) – Breach of sale and purchase agreement involving issues of rescission and duty of solicitors who act for both the vendor and the purchaser to raise requisitions – successfully obtained an order of specific performance.

3G Finance Limited v. Yao Yuan & Anor (Unrep., HCA 2629/2015, 6th December 2017) – Court of First Instance – Trial – Acted for Plaintiff (as sole advocate) – successfully obtained judgment for repayment on behalf of the plaintiff moneylender.

Hou Tsun Tat & Otrs v. Wong Wai Chung (Unrep., DCPI 96/ 2015, DCPI 439/ 2015 & DCPI 476/2015, 31st October 2017) – District Court – Acted for the Defendant (as sole advocate) – Application for setting aside default judgment.

Criminal Cases

HKSAR v. Kwan Yu Hin (STCC 2606/2021) – Successful plea bargain to reduce the charge from trafficking in dangerous drugs to possession of dangerous drugs (as sole advocate).

HKSAR v. Tang Hing Wah (FLCC 1153/2021) – Successful plea bargain to reduce the charge from dangerous driving causing grievous bodily harm to careless driving and the Defendant was fined HK$2,000 (no disqualification order made) (as sole advocate).

HKSAR v. Lau Kin-Yeung (KCCC 2068/2019) – Successful plea bargain for a withdrawal of 3 counts of obtaining property by deception and 1 count of perverting the course of public justice (as sole advocate).

HKSAR v. Yip Chi Wai Tony [2019] HKDC 869 – District Court (as sole advocate) – Mitigation – Burglary & Failing to surrender to custody without reasonable cause.

HKSAR v. Chan Wing-tong (ESS 12312/2019) – Successful plea bargain for a withdrawal of the offence of carrying on a food business of an unlicensed food factory (as sole advocate).
