			<p>Victor has an all-rounded practice and is regularly instructed to handle cases with regards to their civil, criminal and regulatory aspects concurrently. He joined Wong Man Kit SC’s Chambers in 2017 after five years at Liberty Chambers, which he joined in 2012 upon completion of his pupillages with Ms. Charlotte Draycott SC, Mr. Graham Harris SC, Ms. Lisa Remedios, Mr. Lawrence Ng and Mr. Richard Leung and as the judge’s marshall of the Honourable Mr. Justice Line.</p>
<p>Victor maintains a broad civil practice with particular emphasis in the following core practice areas:</p>
<p>(1) <strong>Securities Law</strong> – Victor is regularly instructed to act for listed companies, securities firms and SFC licensed individuals. He appeared in two recent reviews before the Securities and Futures Appeals Tribunal:(1) <strong><em>Cai Hong Ping v Securities and Futures Commission</em></strong> (SFAT 3/2019) (acted for the Applicant in his review against the SFC’s decision to prohibit him from conducting various regulated activities for 5 years under s.196 of the SFO. The review was allowed and the sanctions imposed on the Applicant by the SFC were set aside); and (2) <strong><em>Yi Shun Da Capital Limited v Securities and Futures Commission</em></strong> (SFAT 4/2020) (acted for the Applicant in its review against the SFC’s decision to fine and discipline the company in respect of its conduct as sole sponsor of a listing application. Upon review, the SFC’s decision was upheld but the sanctions imposed were reduced).  He has represented various listed companies and SFC licensed individuals in handling enquiries by the SFC and the HKEX which ultimately resulted in no further action being taken by the regulatory authorities. He is the Editor of <strong><em>Securities Law: Hong Kong SAR and People’s Republic of China</em></strong> (LexisNexis).</p>
<p>(2) <strong>Costs/taxation related matters &#8211; </strong>Victor has substantial experience in costs/taxation related matters. He is regularly instructed to act for law firms and clients in solicitor/own client taxation disputes and costs-related applications. He has acted in various applications for a personal costs order against a non-party pursuant to s.52A of the High Court Ordinance: (1) <em><strong>Ng Hing Yau and another v Kong Art Limited</strong></em> [2022] 2 HKLRD 1153; [2022] HKCFI 1381 (acted for the Plaintiffs and obtained a personal costs order against a third party i.e. the Defendant&#8217;s director; (2) <em><strong>Dung Wai Man and others v Ng Yuk Pui Kelly</strong></em> [2019] HKCFI 1157 (acted for the 4th to 6th Defendants and resisted an application for a personal costs order to be made against them); and (3) <em><strong>Big Island Construction (HK) Limited v Wu Yi Development Company Limited</strong></em> <em><strong>and others</strong></em> [2018] 2 HKLRD 1145; [2019] HKCFI 1157 (acted for the Plaintiffs and obtained a personal costs order against the Plaintiff&#8217;s director). He has represented parties in two recent decisions of the Court of Appeal: (1) <strong><em>Yoe Han Yauw v Yoe Han Hian and others</em></strong> [2022] HKCA 498 (acted for the Applicant in an appeal against an adverse costs order resulting from an Originating Summons seeking inspection of documents pursuant to section 740 of the Companies Ordinance (Cap. 622), in which the appeal was allowed); and (2) <strong><em>Ng Hing Yau and another v Kong Art Limited</em></strong> [2023] HKCA 212 (acted for the Plaintiffs and resisted the Third Party’s application for extension of time to appeal against the First Instance Judgment, in which the Third Party was ordered to personally bear the Plaintiffs’ costs of the action). He is the Current Editor of <strong><em>Lexis Practical Guidance </em></strong>on (1) solicitor and client costs; (2) taxation of costs; (3) general rules about costs; an (4) types of costs order and the Current Editor of <em><strong>Annotated Ordinances of Hong Kong (Costs in Criminal Cases Ordinance)</strong></em>.</p>
<p>(3) <strong>Arbitration</strong> – Victor is regularly instructed to act as counsel in Arbitrations involving commercial, contractual and shipping disputes. In the recent case of <strong><em>EW v HC </em></strong>[2023] HKCFI 2619; <strong>[2023] </strong>HKCFI 3157, he acted for the Claimant in an Arbitration in which the Tribunal allowed the Claimant’s claim for the sum of over US$6.4 million. The Respondent’s application to set aside the Award was dismissed by the Court and the Respondent’s application for leave to appeal against the Court’s decision was also dismissed. He is a member of the Chartered Institute of Arbitrators and the editor of <strong><em>Halsbury’s Laws of Hong Kong (Arbitration)</em></strong> (2012 edition) and <strong><em>Halsbury’s Laws of Hong Kong (Arbitration)</em></strong> (2016 edition).</p>
<p>(4) <strong>Defamation </strong>– Victor is regularly instructed to act as counsel in defamation cases.  In the case of <strong><em>Yu Sau Ning Homer v Wong Wan Keung and ors. </em></strong>[2020] HKDC 40, he acted for the Plaintiff in a 17-day trial of a defamation action in respect of articles alleging wrongdoings of the Plaintiff during his role as the Chairman of the Incorporated Owners of a building (led by Mr. Lawrence Ng). The Court ruled in favour of the Plaintiff and awarded damages of HK$1,000,000. The 2<sup>nd</sup> and 3<sup>rd</sup> Defendants’ application for leave to appeal to the Court of Appeal was dismissed.</p>
<p>Victor has experience of defending criminal cases in all levels of Court. He has also prosecuted for the DOJ at the High Court and in the Magistrates’ Courts. His practice is focused on white collar cases such as money-laundering, complex commercial fraud and SFC regulatory matters.</p>
<p>Victor is a CEDR Accredited Mediator and is listed on the Hong Kong Bar Association’s List of Mediators and the General Mediator Panel of the HKMAAL. He is regularly appointed as the mediator for cases including multi-party commercial disputes, company disputes, construction disputes, matrimonial disputes and property disputes.</p>
<p>Victor has been the Editor of 37 different legal publications including various editions of <strong><em>Halsbury’s Laws of Hong Kong </em></strong> and <strong><em>Annotated Ordinances of Hong Kong</em></strong>.</p>
<p>Victor can conduct cases and draft pleadings in both English and Chinese. He speaks fluent English, Cantonese and Putonghua.</p>

			<p><strong><em><u>Highlights of Recent Cases</u></em></strong></p>
<p><strong>Chen Simon Guomin v Chan Choi Har Ivy and ors [2023] HKCFI 3135</strong></p>
<p>Acted for the Plaintiff in a claim arising from outstanding loans and interest totalling over HK$52 million. The Court ruled in favour of the Plaintiff after trial (led by Mr. Lawrence Ng).</p>
<p><strong>EW v HC [2023] HKCFI 2619; [2023] HKCFI 3157</strong></p>
<p>Acted for the Claimant in an Arbitration in which the Tribunal allowed the Claimant’s claim for the sum of over US$6.4 million. <p><strong>Alpha &amp; Leader Associates Limited v Victory Mega Trading Limited [2023] HKCFI 2322; [2024] HKCFI 788; [2024] HKCA 709</strong></p>
<p>Acted for the Plaintiff and obtained a Mareva injunction against the Defendant up to the amount of approximately RMB 320 million. The Defendant’s application to discharge the injunction was dismissed and the Defendant&#8217;s applications for leave to appeal were also dismissed by the Court of First Instance and the Court of Appeal (led my Mr. Lawrence Ng).</p>
<p><strong>Warren Gary Lichtenstein v Annabelle Sarah Bond and anor. [2023] HKCFI 1511</strong></p>
<p>Acted for the Plaintiff in an application involving issues regarding (1) conspiracy to injure; (2) breach of Quistclose trust; and (3) <em>Henderson v Henderson </em>abuse (led by Mr. Ambrose Ho SC).</p>
<p><strong>Ng Hing Yau and anor. v Kong Art Limited [2023] HKCA 212</strong></p>
<p>Acted for the Plaintiffs and resisted the Third Party’s application for extension of time to appeal against the First Instance Judgment, in which the Third Party was ordered to personally bear the Plaintiffs’ costs of the action. The Court of Appeal affirmed the principle that bad faith or impropriety is not required to support a non-party costs order if it can be shown that the third party would stand to personally benefit from the litigation.</p>
<p><strong>The Incorporated Owners of Sun Hing Building v Join Profit (Hong Kong) Limited and anor. [2022] HKLdT 56</strong></p>
<p>Acted for the Applicant in its claim for a demolition order and injunctive relief regarding the respondents&#8217; occupation of a common corridor. The Court ruled in favour of the Applicant after trial (led by Mr. Lawrence Ng).</p>

<p><strong>Cai Hong Ping v Securities and Futures Commission (SFAT 3/2019)</strong></p>
<p>Acted for the Applicant in his review against the SFC’s decision to prohibit him from conducting various regulated activities for 5 years under s.196 of the SFO. The case involved an assessment of whether the Applicant should be held liable as the purported sponsor principal in relation to an IPO. The review was allowed and the sanctions imposed on the Applicant by the SFC were set aside.</p>
<p><strong>Yi Shun Da Capital Limited v Securities and Futures Commission (SFAT 4/2020)</strong></p>

<p>Acted for the 1<sup>st</sup> Defendant in a dispute over the appointment of the administrator of an estate. The Court ruled in favour of the 1<sup>st</sup> Defendant, appointed the 1<sup>st</sup> Defendant as the sole administrator of the Estate, and dismissed the Plaintiff’s application. The Plaintiff’s subsequent application to vary the costs order nisi was also dismissed.</p>
<p><strong>Ng Yuk Pui Kelly v Estate of Dung Wai Man (deceased) [2021] 1 HKLRD 1037</strong></p>
<p>Acted for the 2<sup>nd</sup> Defendant in applications for stay pending appeal and amending the notice of appeal. The Court of Appeal set out the relevant legal principles regarding stay pending appeal and granting leave to amend a notice of appeal.</p>
<p><strong>Lee Kam Tai v Chan Kam Wah [2021] HKCFI 3496</strong></p>
